1. Introduction and acceptance

These Terms of Use (“Terms”) are a legally binding agreement between you and Cinderwright Ltd, a company registered in England and Wales. In these Terms, “we”, “us” and “our” mean Cinderwright Ltd.

We trade as Folk & Forge and Axis & Ember. We create original 3D printable model files and related digital content, which we make available through third party platforms including Patreon, MakerWorld, Creality FlowPrint, Printables, Cults3D, MyMiniFactory, Nexprint and other platforms (each a “Platform”).

“You” and “your” mean the person accessing or using the files and content we supply through Patreon, MakerWorld, Creality FlowPrint, Printables, Cults3D, MyMiniFactory, Nexprint and such other Platforms.

By downloading, accessing or using any file or content we supply, you confirm that:

  • You have read and understood these Terms and our Privacy Policy.
  • You are 18 or over. If you are under 18, you may only use our files with the consent and supervision of a parent or guardian, who accepts responsibility for your use.
  • You will comply with the terms of any Platform through which you access our content.

If you do not agree to these Terms, please do not download or use our files.

We do not process payments or manage subscriptions. That is handled by the Platform you subscribe through, and their terms apply to those parts of the relationship alongside ours.

Which licence applies to which file. Different Platforms carry different licences. The licence shown on an individual model page or post always applies to that model. In general:

  • Files supplied to subscribers through Patreon may carry a commercial licence, as set out in section 8.
  • Models published free on MakerWorld, Creality FlowPrint, Printables, Cults3D, MyMiniFactory, Nexprint and other repositories are personal use only, under the standard licence offered by that Platform. Downloading a free model never grants commercial rights, whether or not you also subscribe to our Patreon.

2. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to our content, our business, or the law.

Where we make a material change, we will give you reasonable notice through the relevant Platform or by email where we hold your address. Changes will not apply retrospectively to files you have already downloaded under an earlier version of these Terms.

If you do not accept an updated version, you may cancel your subscription or stop using our files. Continuing to download new files after a change takes effect means you accept the updated Terms for those files.

3. Your account

Access to our content is provided through a Platform account, not an account with us.

You are responsible for keeping your Platform login details secure and for activity carried out under your account. If you think your account has been accessed without your permission, tell the Platform straight away and let us know so we can help where we can.

We are not responsible for losses caused by someone else using your account, unless that use resulted from something we did wrong.

4. What we provide

Depending on the Platform and the tier you use, we may provide:

  • 3D printable files. Original models supplied as STL, 3MF or similar formats.
  • Supporting content. Print settings, guides, images, videos and written material.
  • Community access. Posts, discussion and updates on the relevant Platform.

We may update, improve or retire content over time. We may also carry out maintenance or make changes that cause short interruptions. Where we plan to make a substantial change to what a paid tier includes, we will tell you in advance so you can decide whether to continue.

Files already downloaded to your own device remain yours to use under the licence that applied when you downloaded them, even if we later retire them.

5. Payment and billing

Where you subscribe to a paid tier, all payments are taken and handled by the Platform. Their billing terms, payment methods, currency handling and refund policies apply.

  • Keep your payment details current with the Platform. If payment fails, access to subscriber content may be suspended until it is resolved.
  • We do not hold your card details and cannot process payments or refunds directly.
  • We may change our subscription pricing. Any change will be notified in advance and will apply from your next billing cycle, not the current one.

Your statutory rights. If you are a consumer in the UK or EU, you may have a legal right to cancel a purchase of digital content within 14 days. That right can be lost once you have accessed or downloaded the content, where you consented to immediate supply and acknowledged that you would lose the right. Nothing in these Terms limits your rights under the Consumer Rights Act 2015 or any other law that cannot be excluded.

6. Cancellation

You can cancel a subscription at any time through the Platform. We cannot cancel on your behalf.

When you cancel:

  • Future recurring charges stop.
  • You keep access until the end of the billing period you have already paid for.
  • You will not usually receive a refund for the remainder of that period, except where the law or the Platform’s policy says otherwise.

When your subscription ends, you lose access to subscriber areas and to any new content. Any commercial licence also ends, as set out in section 8. Files you downloaded while subscribed remain licensed to you for personal use only from that point onward.

7. Personal use

Unless you hold a current commercial licence under section 8, you may:

  • Print our models for your own personal, non-commercial use.
  • Print them as gifts, provided no money changes hands.
  • Share photos and videos of your prints on social media, with credit to Folk & Forge or Axis & Ember.

You may not sell prints, sell the files, or share the files with anyone else.

8. Commercial licence

If your subscription tier includes a commercial licence, we grant you a limited, non-exclusive, non-transferable and revocable licence to:

  • Print our models on your own equipment, or through a print service acting on your instructions.
  • Sell those finished physical prints, in reasonable quantities, through your own sales channels.

Scope. The commercial licence covers only the files supplied to you under that subscription. It does not extend to models we publish free on any Platform, even where the same design appears in both places. Those remain personal use only.

Duration. The licence applies to prints made and sold while your subscription is live. If you cancel or your access is terminated, the licence ends and you must stop selling new prints made from our files. You may sell through existing stock already produced at the point the licence ends.

Attribution. We ask that you credit Folk & Forge or Axis & Ember as the designer in your listings. You must not present the design as your own work.

Print services. You may use a third party print service to produce items you sell, provided you supply the file only for that purpose, the service does not retain or reuse it, and you remain responsible for compliance with these Terms.

9. Restrictions

Whether your use is personal or commercial, you must not:

  • Sell, share, upload, sublicense, give away or otherwise distribute our files, in whole or in part, in any format, free or paid.
  • Upload our files to any model repository, file sharing site, cloud folder, Discord server or AI training dataset.
  • Claim authorship of our designs.
  • Remove or alter any identifying marks, logos or embedded metadata in our files.
  • Create and distribute derivative or remixed models based on our files without our written permission.
  • Use our files to produce items that are unlawful, or that we have specifically excluded in the listing for that model.
  • Use our files, images or brand names in a way that suggests we endorse, supply or stand behind your business.

Small personal modifications for your own printing, such as scaling or adding supports, are fine. Redistributing a modified file is not.

10. Monitoring and enforcement

We monitor the use of our files and marketplace listings to check compliance with these Terms.

Where we find our files being shared, sold or used outside the licence granted, we may issue takedown notices to the host or marketplace, suspend or terminate your access, revoke any commercial licence, and pursue any other remedy available to us, including a claim for damages.

11. Your responsibilities if you sell prints

If you sell physical items made from our files, you do so as an independent manufacturer and seller. You are not our agent, employee, partner or distributor, and we have no involvement in your sales.

You are responsible for:

  • Product safety. Making sure the items you sell are safe and meet all applicable safety law in the country you sell into, including UKCA or CE marking where it applies.
  • Regulated categories. Satisfying yourself that you may lawfully sell the item. Toys and children’s products, items containing magnets, and anything with a food, cosmetic or medical use are excluded from our licence. You must not use our files to produce items in these categories for sale.
  • Consumer law. Meeting your obligations to your own customers on descriptions, returns, refunds and warranties.
  • Materials and quality. Your choice of filament or resin, print quality, finishing and packaging.
  • Age suitability. Checking that what you sell is suitable for, and sold only to, the appropriate age group in your jurisdiction.
  • Tax. Registering for and paying any tax due on your sales.
  • Customer support. Handling all questions, complaints, faults and claims from people who buy from you.

We supply a digital design file. We do not manufacture, inspect, test, certify or supply the physical items you make from it, and we cannot advise you on whether your finished product complies with the law where you trade.

12. Intellectual property

All our files, designs, images, text, videos, logos and brand names remain our property or that of our licensors. This includes the Folk & Forge and Axis & Ember names and marks.

A licence under these Terms lets you use our files as described. It does not transfer ownership of anything, and it does not give you any rights in our brands.

13. Suggestions and submitted ideas

If you send us ideas, feature requests or feedback, we may use them to improve what we do without owing you payment or credit. Please do not send us anything you consider confidential or want to keep control of.

This does not apply to models or designs you create yourself. Those stay yours.

14. Third party platforms and materials

Our content is delivered through Platforms we do not control. We are not responsible for their availability, security, pricing, policies or performance, and we cannot restore access on their behalf. You must comply with each Platform’s own terms.

We may link to third party sites, tools or suppliers. Those links are for convenience and are not endorsements. We are not responsible for their content or products.

15. Privacy and data protection

We handle personal data in line with UK GDPR and the Data Protection Act 2018. Our Privacy Policy at [INSERT LINK] explains what we collect, why, how long we keep it, and your rights.

In short: we receive limited information from the Platforms you use, such as your username and email address, and we use it to deliver content, answer questions and send updates you have asked for. We do not sell personal data.

16. Suspension and termination

We may suspend or end your access to our content, and revoke any commercial licence, if you:

  • Breach these Terms, in particular the sharing and distribution restrictions.
  • Use our files unlawfully or fraudulently.
  • Behave abusively toward us or other community members.
  • Fail to pay, or your subscription lapses.

Where it is reasonable to do so, we will contact you first and give you a chance to put things right. For serious breaches, such as redistributing our files, we may act immediately.

If we end your access because of a breach, you are not entitled to a refund for the remainder of your billing period. Sections 9 to 13 and 17 to 23 survive termination.

17. Disclaimer of warranties

We supply our files with reasonable care and skill.

We do not promise that:

  • Our files will print perfectly on every printer, in every material, with every slicer or set of settings.
  • Access to any Platform will be uninterrupted or error free.
  • Any particular model will remain available indefinitely.

3D printing outcomes depend heavily on your equipment, materials, environment and settings. Where a file has a genuine defect, tell us and we will fix or replace it. If you are a consumer, your rights under the Consumer Rights Act 2015 apply in full and nothing here reduces them.

18. Limitation of liability

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Anything else that cannot lawfully be limited or excluded.

Subject to that:

  • If you are a consumer, we are responsible for loss you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. We are not responsible for unforeseeable loss, or for loss arising from how you use our files, including damage to printers, wasted material or failed prints.
  • If you are a business user, we are not liable for loss of profit, loss of business, business interruption, loss of data or any indirect or consequential loss. Our total liability to you in connection with these Terms is limited to the total amount you paid us in the 12 months before the claim arose.

We are not liable for physical items you produce or sell, or for any claim brought by your customers or any third party in connection with them.

19. Indemnity

If you use our files in the course of a business, you agree to indemnify us against any claim, loss, damage, cost or expense, including reasonable legal fees, arising from:

  • Items you have made, sold, supplied or distributed using our files.
  • Your breach of these Terms.
  • Your breach of any applicable law, regulation or third party right.

This section applies to business users only. It does not apply to you if you are using our files purely as a consumer, and it does not affect your statutory rights.

20. Events outside our control

We are not liable for delays or failures caused by events beyond our reasonable control, including Platform outages, internet or power failures, cyber attacks, fire, flood, extreme weather, industrial action, illness, or government restrictions.

If such an event occurs, we will let you know and our obligations are paused until it is resolved. If it continues for an extended period, either of us may end the subscription and you will be refunded for any period paid for but not received, through the relevant Platform.

21. Transfer of rights

We may transfer our rights and obligations under these Terms to another business, for example on a sale or reorganisation. We will tell you if this happens, and it will not reduce your rights. If you object, you may cancel your subscription.

You may not transfer your rights or your licence to anyone else without our written permission.

22. Severability

If any part of these Terms is found to be unlawful or unenforceable, the rest continues to apply. The affected part will be treated as replaced by the closest lawful equivalent.

23. Entire agreement

These Terms, together with our Privacy Policy and the licence shown on an individual model page or post, form the whole agreement between us regarding our files and content. Where the licence on a model page differs from these Terms, that licence applies to that model.

24. Governing law and jurisdiction

These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
